In an unpublished and historical mistake, a court of the Supreme Court condemned to 25 years of jail the ex-president Alberto Fujimori for the murder crimes related to two slaughters committed by a squadron of annihilation, and for the sequestration of a businessman and a journalist during his management.
The verdict announced after 16 months of hearings, generated indignation feelings between the fujimoristas sympathizers and expressions of satisfaction on the part of the relatives of the victims of the slaughters, and defenders of the human rights.
The Special Penal Room of the Supreme Court found guilty Fujimori as "mediate author" of the slaughters, based on a legal theory, which indicates the responsibility of the one who commits a crime by means of others.
The theory of the mediate responsibility has been applied previously in Argentina and Germany, and also in Peru, in case of the maximum leader of the terrorist group Luminous Footpath, Abimael Guzmán, condemned to life imprisonment.
Immediately, Fujimori, of 70 years, affirmed that there will appeal the mistake, which reading took little more than three hours.
" I interpose nullity resource", he said, when it was needed from him to express his position with regard to the judgment.
In accordance with the sorrow, the ex-president might go out freely of prison on February 10, 2032, since two years of seclusion have been taken into consideration that it has already expired to the date.
Fujimori, and his two children, Keiko Sofía and Kenji, presents in the hearing, reacted calmly on having heard the mistake. Then the ex-president left the judicial room smiling and greeting with the hand in high place his relatives.
César San Martín, president of the court, said that the committed crimes constituted "the most serious and severe desvaloración of the person" on the part of Fujimori.
The district attorney José Peláez, who had asked for 30 years of jail, said to the court that he was considered to be satisfied. Later, he declared that the verdict "is an example of what is to do justice in a constitutional state".
It is foreseen that the process of appeal and the review of the case will take approximately four months.
Fujimori, which governed in an authoritarian way Peru during a decade (1990-2000), was accused of murder, forced disappearance and serious injuries by the slaughters of High Quarters (1991) and Cantuta (1992), committed by a squadron of annihilation of the army, who accused the victims of being terrorists. Also it was accused by the sequestrations of the journalist Gustavo Gorriti, and of the businessman Samuel Dyer, in 1992.
Fujimori already fulfills a judgment of six years of jail for functions usurpation and faces another two penal processes for corruption.
With this mistake, Fujimori turned into the first constitutional president in the world in being condemned in its own country for violations of the human rights, stood out international observers.
In High Quarters, in Lima, 15 persons were riddled by machine guns with muffler when they were taking part in a social meeting. Four persons survived. In the University of The Cantuta, nine students and a teacher were kidnapped and murdered, and his bodies burned and buried in the outskirts of Lima.
The court declared that 25 victims and four survivors "neither were linked to the terrorist actions of Luminous Footpath, nor were integrating this criminal organization".
